India's Enforcement Directorate took senior Samajwadi Party leader Azam Khan into custody on Saturday minutes after he walked out of Rampur district jail, in a money-laundering case tied to the university he founded. Officials said he will be produced before a special Prevention of Money Laundering Act court in Ghaziabad on Sunday, where formal arrest procedures are expected.
A team from the agency's Lucknow zonal office had reached the jail before his release and was waiting at the exit, officials said. Some reports said his son, Abdullah Azam, was also taken in; the agency's detailed statement so far concerns Azam Khan.
Bail in one case, custody in another
Azam Khan had been lodged in Rampur jail since November last year, after a conviction in a forgery case. He came out after the Allahabad High Court granted him bail in the dual PAN card matter. The release lasted only until he stepped outside.
Speaking to reporters at the gate, he said there was little left to say. He alleged that the rule of law had vanished and that he was being punished for being a Muslim, asking whether his crime was to build a university and schools for children.
What investigators allege
The ED says it is examining alleged diversion of government contract funds through private contractors, with the money used to create assets for the Maulana Mohammad Ali Jauhar Trust and Mohammad Ali Jauhar University. In the agency's words, its probe has found "financial transactions between certain contractors and the trust", including substantial donations and construction works.
Azam Khan founded the private university in Rampur in 2006, and the trust that holds its campus is controlled by him. He is also its honorary chancellor. These remain allegations; no court has ruled on them.
Three months of escalation
| Date | What the ED did |
|---|---|
| August 19, 2026 | Searched 10 premises in Rampur, Saharanpur and Delhi under the PMLA |
| October 13, 2026 | Questioned Azam Khan inside Rampur jail and recorded his statement |
| October 28, 2026 | Attached the university's land and buildings: Rs 426 crore book value, about Rs 1,170 crore market value |
| October 31, 2026 | Took him into custody on release from jail |
| November 1, 2026 | Due before the special court in Ghaziabad |
Why this case matters beyond Rampur
Azam Khan is a 10-time MLA from Rampur Sadar, a former Uttar Pradesh cabinet minister and one of the Samajwadi Party's most prominent Muslim leaders. He has spent much of the past several years in jail on a long list of cases, walking free after almost 23 months in September 2025 before returning to prison weeks later.
His party, led by Akhilesh Yadav, is India's main opposition force in Uttar Pradesh, where assembly elections are due in early 2027. Any custody order this close to that campaign will be read politically on both sides. For the students and staff of Jauhar University, the more immediate question is what the attachment of the campus means in practice. Under the money-laundering law, attachment does not by itself close an institution, but it stops the property being sold or transferred while the case runs.
Ghaziabad on Sunday
The Ghaziabad court is expected to decide on Sunday whether to send Azam Khan to ED custody for questioning or to judicial custody. The agency last questioned him inside Rampur jail on October 13.
